This clearly was not going to be an effective long-term solution. COPPS, Patrol and other City Divisions began to work to draft a new ordinance that would be constitutional. Many many meetings were held, while enforcement in the field continued. Fast forward to 2004, a new ordinance was drafted that dealt with the swarming of vehicles in the roadway. It completely ignored anything dealing with the free speech issue. Within months of this new ordinance becoming law, another federal judge has stopped our enforcement of this new ordinance barring a new trial. At present, there is no enforceable ordinance that deals with the number of people standing on sidewalks, waiting to swarm out into the street to be the first to contact a potential employer. This requires that multiple officers continue to be assigned near the area where the undocumented workers tend to congregate in an effort to keep the numbers manageable.
